In short, not always, but there are some important rules to follow if you’re monitoring public spaces or recording members of the public.

Do You Need a Licence for CCTV?

Most businesses do not need a licence to install and operate CCTV on their premises. However, if your cameras record people outside your business boundaries—for example, on a public footpath, road, or neighbouring property—you must comply with the Data Protection Act 2018 and the UK GDPR.

You won’t need a licence, but you are legally required to:

  • Register with the Information Commissioner’s Office (ICO) and pay an annual data protection fee
  • Put up clear signs to inform people they are being recorded
  • Ensure footage is stored securely and only kept for as long as necessary
  • Allow people to request access to footage that includes them

Failing to meet these obligations could result in fines or enforcement action from the ICO.

When Would a CCTV Licence Be Required?

There’s only one situation where a business may need a licence for CCTV—if you’re supplying CCTV services to other businesses. In this case, your staff may be classed as working in a licensable role under the Security Industry Authority (SIA).

For example:

  • Monitoring CCTV feeds on behalf of other companies
  • Watching for criminal activity in real-time and responding
  • Supplying CCTV operators to other organisations

If that applies, you or your staff must hold an SIA CCTV Operator Licence.

What About Audio Recording?

Audio recording is far more sensitive than video. While video surveillance is widely accepted in businesses, recording conversations is rarely justified and can be seen as intrusive. If your system records sound, you’ll need a clear and lawful reason to do so—and you must tell people.

In most cases, it’s best to disable audio recording unless it’s absolutely necessary.
